digiMall Terms of Service

Introduction

Welcome to digiMall, an online marketplace platform that connects buyers and sellers of various products without intermediaries. These Terms of Service ("Terms") govern your access to and use of the digiMall website, mobile app, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

Definitions

• "Buyer" means a user who purchases products on the Platform.
• "Vendor" means a user who sells products on the Platform.
• "Product" means any item or service listed for sale on the Platform.
• "User" means a Buyer, Seller, or any other person who accesses or uses the Platform.

Account Registration and Security

1. To use the Platform, you must create an account ("Account") by providing accurate and complete information, including your name, email address, password, NIN or CAC Registration number.
2. You are responsible for maintaining the confidentiality and security of your Account, including your password and payment information.
3. You agree to notify digiMall immediately of any unauthorized use of your Account or any other breach of security.

Platform Usage

1. The Platform is available for use by individuals aged 18 and above.
2. You agree to use the Platform only for lawful purposes and in accordance with these Terms.
3. You must not:

• Use the Platform to harass, abuse commit fraud, or intimidate any person.
• Post or transmit any content that is false, misleading, or defamatory.
• Engage in any activity that interferes with or disrupts the Platform.
• Attempt to gain unauthorized access to the Platform or any other user's Account.

Buying and Selling on the Platform

Payment Terms

1. DigiMall accepts various payment methods, including debit cards, and online payment services.
2. You agree to pay all applicable fees and rental charges associated with your use of the Platform.
3. digiMall reserves the right to modify or waive any fees or charges at any time.

Intellectual Property

1. The Platform, including all content, graphics, and logos, is the property of DigiMall or its licensors.
2. You agree not to reproduce, distribute, or display any content from the Platform without DigiMall's prior written consent.

Disclaimer of Warranties

1. The Platform is provided on an "as-is" and "as-available" basis.
2. digiMall disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

1. In no event shall digiMall be liable for any damages, including consequential, incidental, or punitive damages, arising out of or related to your use of the Platform.
2. digiMall's liability for any claim arising out of or related to this Agreement shall be limited to the amount of fees paid by you to DigiMall in the preceding 12 months.

Termination

1. DigiMall may terminate or suspend your Account and access to the Platform at any time, without notice, for any reason.
2. Upon termination, you agree to cease using the Platform and to destroy any materials obtained from the Platform.

Governing Law

1. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
2. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the Consumer Protection Council (CPC)

Changes to Terms

1. DigiMall reserves the right to modify or update these Terms at any time.
2. Changes to these Terms will be effective upon posting on the Platform.
